The Minister for Transport, conscious of the widespread concern among holders of provisional licences, that from Tuesday next driving while unaccompanied would lead to prosecution, has discussed this issue with the RSA and the Garda authorities.
The current law means that first, third and subsequent provisional licence holders should be accompanied at all times. There is no change to this provision.
The change in the law applies to holders of second provisional licences.
The Minister understands that the Gardaí will approach each case, using discretion and common sense as opposed to automatic prosecution.
The Minister believes that sensible Garda enforcement of that type will mean that for an initial period of a few months Garda efforts in the main will be aimed at cautioning and advising unaccompanied drivers of the new legal requirements.
The RSA has also indicated that the Authority will prioritise drivers who face particular difficulties and will also bring on additional capacity immediately.
The Insurance Federation has confirmed that the change in law effecting second provisional licence holders does not change their insurance status.
